The short version

If you use Sendspark’s AI video features, we create a model of your voice, and we scan your face geometry while your video is being generated, so that a video you recorded once can be personalized for many different recipients.

• We never store your face. The face scan happens while your video is being made and is discarded as soon as it is finished. No facial template is kept.
• Your voice model is deleted within three months of being created, whether or not you keep using the feature.
• You turn this on, not your employer and not us. It only happens if you personally enable the feature and agree to this notice.
• It is only ever used to make your own videos. No other customer, and no other user, can generate anything with it.
• We do not use it to train our AI, or anyone else’s. Not our models, not general models, not evaluation or benchmarking datasets.
• You can withdraw at any time, and we stop and delete.
• We never license, sell or commercially exploit your voice, face, name or likeness.

1. Who this applies to

This notice applies to you, the person who records a video in Sendspark and chooses to use our AI video features.

It does not apply to the people who receive your videos. We do not collect biometric information from viewers, recipients or prospects.

If you use Sendspark through your employer’s account, this notice and the consent below run directly between you and Sendspark. Your employer cannot give this consent on your behalf, and withdrawing it is your decision, not theirs.

2. What we collect and what we create

To use our AI video features you record a short video of yourself reading a phrase we provide (the Specimen). From that recording:

We create your Voiceprint. A model of the distinctive characteristics of your voice. This lets the Service generate new speech in your voice, so a single recording can be personalized for many recipients, for example by saying each recipient’s name. Your Voiceprint is stored, and section 5 explains for how long.

We scan your face geometry. Each time a personalized video is generated, your face geometry is scanned so that your appearance matches the personalized speech. This scan happens as part of generating that video and is discarded once the video has been produced. We do not build or keep a facial template, and there is no stored model of your face.

We refer to your Voiceprint and your face geometry scan together as your Biometric Data. Both a voiceprint and a scan of face geometry are named as biometric identifiers under laws including the Illinois Biometric Information Privacy Act. We treat both as biometric information and handle both under this notice, including the face scan, even though it is not retained.

3. What we use it for, and what we do not

We use your Biometric Data for one purpose: to generate personalized videos that you request, from content you recorded, in the account where you enabled the feature.

We do not:

• Use your Biometric Data, your recordings, or anything derived from them to train, develop, evaluate or improve any general, shared or foundation AI model, whether ours or a third party’s
• Use them in evaluation sets, benchmarks, test fixtures or training datasets of any kind
• Make your Voiceprint available to any other Sendspark customer or any other user, including others in your own organization
• Sell, lease, trade, license or otherwise profit from your voice, face, name, image or likeness
• Use your voice or likeness in our own marketing without asking you separately

Your Voiceprint is associated with the account that created it and cannot be used by any other account.

4. Who processes it

We do not store your Biometric Data on our own servers. It is processed on our behalf by specialist providers, under contract. Your original recording and the videos generated from it are held by our video hosting provider, also on our behalf and under contract.

All of these providers are named, with the purpose of each, in our Subprocessor List. All are located in the United States.

These providers may only process your information to deliver the service to us. They are contractually prohibited from using it for their own purposes, including to train their own models, and they are bound by written obligations no less protective than those in our Terms of Service and our Data Processing Addendum.

5. How long we keep it

Why these differ. Your face geometry is only needed while a video is being produced, so it is discarded at that point and never stored. Your Voiceprint has to persist so you can generate videos without re-recording, so it is destroyed on a short fixed schedule instead. If you record again after it expires, a new Voiceprint is created and a new three-month period begins.

Your recordings and finished videos are your own content, and customers generally want them kept and available while their account is open. So they are retained while you are a customer and removed when you ask, or shortly after the account closes. You can ask us to delete your recordings and videos at any time, without withdrawing your consent under this notice, and vice versa. They are separate requests.

6. Your consent, and withdrawing it

Your consent is required before we create your Voiceprint or scan your face geometry. If you do not give it, we do neither.

You may withdraw your consent at any time, in the product or by emailing the address in section 9. There is no penalty and no need to give a reason. When you withdraw:

• We stop generating any new videos from your Voiceprint, so no further face scanning occurs
• We delete your Voiceprint without undue delay
• There is nothing to delete in relation to your face geometry, because it was never stored
• Videos you have already generated remain yours and are unaffected, unless you also ask us to delete them
• You can consent again later, which creates a new Voiceprint and a new retention period

We also delete your Voiceprint without undue delay if your account is deleted, or if you are removed from the account where you enabled the feature.

7. If you do not consent

You can use Sendspark without giving this consent. You will be able to record and send videos as normal. You will not be able to use the AI video personalization features, because those require a Voiceprint and a face geometry scan.

8. Your other rights

Depending on where you live you may have additional rights, including to access the information we hold about you, to have it corrected, to have it deleted, and to restrict how it is processed. Our Privacy Policy explains these and how to exercise them.

This notice is intended to comply with applicable biometric privacy laws, including the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act (CUBI), and Washington’s biometric privacy statute (RCW 19.375).

The consent you give

Before your Voiceprint is created, the product asks you to confirm that:

1. You have read this Biometric Information Notice and Consent and the Sendspark Privacy Policy
2. You understand that X6 SS Acquisition Corporation (d/b/a Sendspark, Inc.) and the service providers named in its Subprocessor List will create and store a model of your voice (your Voiceprint), and will scan your face geometry each time a video is generated
3. You understand these will be used only to generate videos you request in your own account, and not to train any general or shared AI model, and not for any other customer
4. You understand that your face geometry scan is not retained and is discarded once your video has been produced, and that your Voiceprint is deleted no later than three (3) months from the date it is created, or sooner if you withdraw this consent, your account is deleted, or you are removed from the account where you enabled the feature
5. You are giving this consent for yourself. If you are recording on behalf of an organization, that organization is not giving it for you and cannot withdraw it for you
6. You may withdraw this consent at any time, and you know how to do so

You give this consent by checking the consent box in the product before you record your Specimen. If you do not consent, you can still record and send videos. You will not be able to use AI video personalization.
